General information


Thank You for choosing Avis. Below You will find the information required for the car rental, and to ensure that Your journey is as simple and comfortable as possible. The information below constitutes an annex to the General Terms and Conditions (GTC) employed by AUTO ReFAIRent Autókölcsönző és Szolgáltató Korlátolt Felelősségű Társaság, representing Avis as the exclusive owner of the Avis Budget Group Franchise in Hungary (the Lessor); the Lessor shall retain the right to unilaterally amend the document. The provisions of the General Terms and Conditions shall apply to and govern all vehicle rentals in the territory of Hungary, as consented to by the Lessee when signing the Rental Agreement. Before finalising the car rental, please review this document and read the Booking Conditions and the General Terms and Conditions.

Our guaranteed fees are in EUR, and shall be provided as such in the Car Rental Agreement.
The prices indicated include Value-Added Tax (VAT). VAT in Hungary is 27%.

In all cases, bookings shall be confirmed with regard to vehicle category, not the specific vehicle type/model. For the vehicle categories available at specific Hungarian Avis locations, see the following link: https://www.AVIS.hu/irodak-es-szolgaltatasok/magyarorszagi-irodak.

DRIVER’S LICENSE, PERSONAL DOCUMENTS
The Lessee must have had a valid driver’s license for at least one year, and possess an ID card / passport. Driver’s licenses not issued in Latin characters shall not be accepted by the Lessor; in such cases, the Lessee shall only be entitled to rent a vehicle upon presenting both an international driver’s license and the original documents. If the Lessee is from a state outside the European Union and/or the Vienna Convention on Road Traffic, they shall only be entitled to rent a vehicle upon presenting both an international driver’s license and the original documents.

PAYMENT METHODS
The Lessee must have an embossed international debit or credit card in their own name, valid for at least 60 days after the end of the rental period. Electron and Diners cards shall not be accepted for Hungarian rentals; only embossed American Express, Visa and MasterCard debit and credit cards shall be accepted. Credit cards issued by “neo-banks” shall also be rejected (e.g. those issued by Revolut, Wise, Monese, Monzo Bank, N26, Curve 1 or Starling Bank), even if they have a Visa or MasterCard logo. For category “L” rentals, 2 of the following embossed credit/debit cards shall be required (with one being a gold card): Amex, Visa, MasterCard (Electron cards shall not be accepted). The two cards must be under the name of the same person.
A so-called security (deposit, guarantee) will be deposited from the credit card until the 60th day after the Rental Period (depending on the issuer of the card, banks may release the security within 30 days after the end of the rental). Cash security payments shall not be accepted. The amount of the required security may differ depending on the vehicle category; information will be provided by the rental office.
Avis credit cards and other means of payment (e.g. voucher) issued by Avis shall also be accepted. When paying with certain types of vouchers, an additional debit/credit card may be required.
If rent for business purposes, fees may only be paid via credit transfer after preliminary rating and the conclusion of a corporate contract.

TAKING OVER AND RETURNING THE VEHICLE
The Lessee receives the vehicle in appropriate technical and aesthetic condition and shall be obligated to return it in the same condition – other than normal wear and tear – as specified in the GTC and at the return location and time agreed upon in the Car Rental Agreement. By signing the Car Rental Agreement, the Lessee acknowledges that they have received the vehicle in the condition indicated in the agreement and in accordance with the GTC. The Lessee shall be responsible for the condition of the vehicle until it is officially handed over to the Lessor or an authorised agent of the Lessor.




Mandatory Payments



RENTAL FEE
The rental fee shall cover the following – unless different conditions are expressly specified:
• rental fee and associated usage on a km basis, in accordance with relevant rates,
• mandatory insurance,
• electronic license enabling unlimited usage of Hungarian highways,
• costs of oil change, mandatory maintenance,
• phone assistance and replacement car service.

The rental fee does not cover fuel, damage payments, charges for kilometres travelled over the limit, repair costs arising due to unintended usage, and any costs and expenses arising in the course of the car rental and not listed in this section.
The minimum rental period is 1 day (24 hours). 1 month of rental shall equal 30 days. For delays exceeding 30 minutes, an additional rental day will be charged. Weekend rates shall apply from Friday 8:00 AM to Monday 9:00 AM; weekend rates cannot be combined with any other rates.

AIRPORT SURCHARGE
When renting from an airport office, an airport surcharge will be charged, equal to 16% of the net rental fee, but is at least 31.75 €.

VEHICLE LICENSE FEE
The Vehicle License Fee (VLF) includes, among other things, the tax on company cars and free use of Hungarian highways. The VLF may differ depending on the vehicle category, and shall be calculated on the following basis, up to a maximum of 15 days per month (per 30 days):
• For categories A, B, C, D, I: gross 14.48 €/day
• For categories E, F, H, K, M, N, O, P: gross 15.24 €/day
• For categories G, L, J: gross 18.29 €/day

WINTERISATION FEE
The winterisation fee is 12.70 €/day, applied between 1 November and 31 March, up to a maximum of 15 days per month (per 30 days). Winterisation includes winter tires, winter windscreen washer, ice scraper.

YOUNG DRIVER FEE
The vehicle may only be used by the specified person who .must have had a valid driver’s license for at least one year and be above 25 years of age. A 10.16 €/day young driver fee is applied for people aged 21-25 and rent vehicles of categories A, B, C, D, E, I, up to a maximum of 15 days per month (per 30 days).



Optional Services


INFORMATION ON SECOND DRIVERS
Only the person(s) indicated in the Rental Agreement may drive the vehicle. Second drivers may be specified upon rental or during the rental period, against a gross 15.24 €/rental/second driver fee; for long-term rentals, this fee shall be applied in month-long (30 day) units. Both the Lessee and the Second Driver(s) must meet the conditions outlined in the General Terms and Conditions.

TAKING THE VEHICLE ABROAD
Crossing the border and territorial limitations: any intention for international travel must be indicated when receiving the vehicle. The Lessee shall only be entitled to travel with the vehicle abroad with prior, written authorisation from the Lessor – issued prior to the conclusion of the Car Rental Agreement.
The fee for international usage is gross 25.40 €/rental, applied maximum monthly (30 days).
The Lessee hereby acknowledges that entering the following countries with the rented vehicle shall be prohibited: Albania, Bosnia and Herzegovina, Bulgaria, Estonia, Belarus, Kosovo, Latvia, Lithuania, Macedonia, Moldova, Montenegro, Russia, Serbia, Ukraine.
Entry into Serbia is allowed only with vehicles of the A, B, C, D categories, against the payment of a cross-border permit fee equal to gross 25.40 €/pass, up to a maximum of a month (30 days).

If the Lessee travels with the vehicle abroad or to a prohibited country without prior written authorisation from the Lessor, the Lessee shall not be entitled to assistance services; furthermore, the Lessor may press criminal charges against the Driver on the basis of unlawful vehicle usage, report the vehicle stolen and charge and claim from the Lessee an unauthorised usage fee equal to 75 € per day in addition to the rental fee and any costs incurred.

DELIVERY AND RETURN BY THE LESSOR
If requested in advance, the Lessor can undertake delivery and/or return against a surcharge. This service is provided only during business hours, in cities with Avis offices, against gross 25.40 €/transport. If requested by the Lessee in advance, delivery to and return from outside of Avis cities is possible, but in such cases the transportation fee shall be gross 0.64 €/km, but at least 38.1 €. This transportation fee shall also apply when transporting vehicles from otherwise unavailable categories to Avis offices in rural areas. Distance shall be calculated from the Avis offices of the Lessor in Budapest (H-1051 Budapest, Arany J. u. 26-28.).

SERVICE PROVIDED OUTSIDE BUSINESS HOURS
Taking over vehicles outside the business hours of the Lessor’s office is only feasible at the Lessor’s airport offices, by providing the flight number and until 0:00 AM. This service is only provided for confirmed advance bookings. The fee is gross 21.59 €/hour after each hour started.

RETURNING VEHICLES OUTSIDE BUSINESS HOURS
Returning vehicles outside business hours is possible only at the Lessor’s airport offices and the downtown Budapest office, where the rented vehicle’s key(s) and documents are to be placed in the designated security storage (“return box”).

ONE-WAY RENTAL – DIFFERENT RETURN LOCATION
Return delivery, domestic one-way pass: the rented vehicle can be returned to an Avis office within the country different than the pick-up location, subject to a return delivery fee. Return fees vary by location; the Lessee may inquire about rates during online reservation or prior to the rental, at the lessor’s offices.
International return, international one-way pass: the rented vehicle can be returned to a designated Avis office in another country different from the pick-up location, subject to a return delivery fee. Return fees vary by location; the Lessee may inquire about rates during online reservation or prior to the rental, at the lessor’s offices.

FUEL, REFUELLING SERVICES
Rented vehicles are provided with a full tank of gas; at the end of the rental, charges for the missing portion of the fuel (gross 4.45 €/litre) will apply, along with a refuelling service fee (gross 16.51 €).

DRIVER SERVICE
Vehicles of all categories may be rented with a driver for a minimum of 6 hours and only by prior order. As part of the chauffeur service, highly skilled and continuously trained drivers, able to speak English at a conversational level, with impeccable appearance and full discretion are available to clients. If requesting a driver, accommodation and daily expenses, as well as incidental costs shall be borne by the Client for the entire rental period, both for domestic and international trips. As part of the chauffeur service, additional services may be requested according to individual needs; the Contracting Parties will agree on these within the framework of individual orders.

SECURITY OPTIONS AND LIABILITY MITIGATION PRODUCTS
The rental fee includes mandatory Liability Insurance (LI), and – unless otherwise specified in the Rental Agreement – Collision Damage Waiver (CDW) and Theft Protection (TP), with a damage payment obligation.
If no liability mitigation products are accepted, the Lessee shall be fully liable for collision damage resulting from an Accident due to circumstances within the Lessee’s control, and for the total cost of recovery in case of theft.

Damage reduction, damage waiver: by employing a Super Collision Damage Waiver (SCDW), the rate of the damage payment, i.e. the Lessee’s financial liability in case of collision damage may be reduced to 50% or even zero.

If CDW is purchased, damage payments after collision damage can be reduced further with extra protection to 50%. The fee is gross 10.16 €/day, applied maximum 15 days per month (for long-term rentals monthly, i.e. every 30 days).

If a full damage waiver is purchased, damage payments after collision damage are reduced to 0. The fee for this is
gross 21.59 €/day, applied maximum 15 days per month (for long-term rentals monthly, i.e. every 30 days).

Liability mitigation products do not cover damages to tires, rims, antennas, damages caused by the use of improper fuel, or any damages occurring in the interior or cargo area, for which the Lessee’s liability shall apply fully, irrespective of the damage payment.
The SCDW option is not available at all Avis offices; for further information, please contact the offices providing the rental.

Personal Accident Insurance (PAI): gross 6.35 €/day. Accident insurance, if purchased, shall cover all passengers in the vehicle:
• for the period designated in the Rental Agreement,
• with regard to their presence within the vehicle and entering and exiting the vehicle, without territorial restriction,
• All passengers in the vehicle under the age of 80, provided that the number of passengers in the vehicle at the time of the accident did not exceed the maximum prescribed in the registration document.
The insurance shall not cover cases where bodily harm results from an accident originating from or connected to a nuclear, biological, chemical act of terror. The insurer contracted by the Lessor for the Personal Accident Insurance will determine and pay to the claimant the amount of the insurance in Hungarian forint.

Extras, Additional Equipment


The Lessee may request additional equipment for the vehicle against a premium. If the Lessee requests additional equipment from the Lessor, the Lessee hereby acknowledges and expressly accepts the relevant terms of use, and the fees charged for such additional services. Following the completion of the rental, the Lessee shall be obligated to return to the Lessor any and all accessories (navigation tools, snow chain, child safety seat, etc.) rented together with the vehicle in the same condition as originally provided and fit for their intended purpose.
The following additional equipment can be requested via advance order, depending on availability:

Navigation system (GPS): gross 10.16 €/day, applied max. 15 days per month
Snow chain: gross 21.59 €/rental, for long-term rentals, this fee shall be applied on a monthly basis.
Baby carrier: gross 10.16 €/day, applied max. 10 days.
Child safety seat: gross 10.16 €/day, applied max. 10 days.
Booster seat: gross 6.35 €/day, applied max. 10 days.



Penalties, Surcharges


OTHER FEES AND TAXES: operating fees and any other fees, expenses incurred in the course of the rental period (including in particular, but not limited to: parking, road tolls, ferry fees, fuel costs, external and internal cleaning, upholstery cleaning fees, fines, penalties issued by parking companies, authorities, courts, insurance damage payments, obsolescence, damage and other depreciation, any and all expenses, damages incurred due to misuse, use of incorrect fuel, cost of refilling lubricants and other liquids (e.g.: AdBlue additive, window washer fluid, etc.), excessive wear, costs of removing stains, etc.) shall be borne by the Lessee.

ADMINISTRATION FEE
In case of any expenses, fines, surcharges incurred due to a violation of traffic laws, a government office administration and damage settlement administration fee shall be charged; the fee is gross 25.40 €/case.

REPLACEMENT FEE
In case of any damage or loss, the following replacement fees shall apply:
• Vehicle documents (e.g.: registration, green card, etc.): gross 127 €/document
• Damage, loss of license plate: gross 127 €
• Loss of original keys: gross 510 €
• Damage, loss of navigation system (GPS): gross 300 €/piece
• Damage, loss of snow chain: gross 150 €
• Damage, loss of baby carrier, child safety seat: gross 200 €/piece
• Damage, loss of booster seat: gross 100 €/piece
• Damage, loss of high-visibility vest: gross 3 €/piece
• Damaged or missing safety kit (warning triangle and first aid kit): gross 50 €/piece
• Use, damage, loss of tire repair kit: gross 150 €
• Cleaning charge: in case of particular dirtiness or if upholstery cleaning or disinfection beyond normal internal cleaning is necessary, an extra cleaning fee is charged, equal to: gross 127 €/occurrence
• Violation of the prohibition on smoking in the car: 200 €/case

PENALTIES
The Lessee shall be obligated to comply with applicable and effective national and international traffic regulations and, as the user of the vehicle and as a person holding a driver’s license, cannot claim ignorance of such legislation. The Lessee acknowledges and expressly agrees that the Lessor shall be entitled to claim reimbursement from the Lessee for costs related to any parking violations committed by the Lessee (fines, surcharges, etc.), as well as any administrative fines incurred, in the same manner as used for the collection of the rental fee, without a time limit, even after termination of the rental.

DECLARATION OF STRICT LIABILITY
In Hungary, pursuant to the 1 May, 2008 amendment to Act I of 1988 on Road Transport, the owner/operator of a vehicle may be held liable for misdemeanours committed using their vehicle. Authorities penalise traffic violations particularly severely. Please adhere to the speed limits and other regulations of the Highway Code!
Pursuant to the legislation, car rental companies have an obligation to produce a document of probative value (declaration of strict liability) forming an annex to the car rental agreement, certifying that at the given time, the Lessee was using the vehicle. The user’s information must be submitted to the authority, which, in accordance with the legislation, takes action and ensures the collection of the fine. In addition to the Rental Agreement, the Lessee must always complete and sign the declaration, which is an essential condition for the validity of the Rental Agreement; for it to become a document of probative value, it must be authenticated by two witnesses at the time of its signing. The declaration must include the exact start and end dates of the rental period. The Lessee’s (user’s) liability to the authority extends to the duration between these two dates. In all cases, the accurate personal information of the driver must be provided, along with an address, which the Lessee, whether a Hungarian citizen or a foreign citizen residing in Hungary, shall be obligated to verify with an address card/address card registration form. Only the person specified in the order or reservation can pick up the vehicle.

Please assist us in our work during the order/reservation process by providing the accurate information of the driver and by filling out the declaration on-site accurately.

Unless otherwise decreed, the rental shall be governed by the provisions stipulated in the General Terms and Conditions applicable on the day the Car Rental Agreement comes into effect.
