Terms and Conditions pay at the rental station


SCOPE OF APPLICATION

These general conditions for the Avis vehicle booking service (hereinafter, "General Conditions"), govern any vehicle booking made using the Pay when you Pick Up your Vehicle process via the www.avis.es web site (hereinafter, "Web site"), owned by AVIS ALQUILE UN COCHE, S.A. (hereinafter, "Avis"), with registered office at Avda. de Manoteras, 32 - Edificio C, 28050 Madrid. Avis is a company legally incorporated in Spain, with Tax I.D. number A-28152767, registered in the Mercantile Register of Madrid, in Volume 2552 general, Section 8, Folio 68, Sheet M-44527, with email address atencion.alcliente@avis.es. The user of the booking service (hereinafter, "User") should read the General Conditions before accessing the service since its use by Users thereof implies, in all cases, abiding by the version of the General Conditions published by Avis on its Web site, which will be available at all times in Spanish, at the actual time of accessing the service. The steps that should be followed in order to make a booking are those described in these General Conditions, and any other specific conditions that are shown on screen while online, so the User declares that he knows and accepts said procedures as necessary in order to book the vehicle. In this respect, Avis states that no electronic document is generated while using this booking service, so there is no possibility of one being held or accessed by third parties. In the same way, using the booking service implies that the User will abide by the Avis Disclaimer included on the Web site and which can be accessed via the following Disclaimer link, which should also be consulted before using the aforementioned services.

ORDER AND PREVALENCE

These General Booking Conditions may be complemented and/or modified where applicable by (1) the Terms and Conditions for Payment in Advance and (2) the Terms and Conditions of the Avis Prestige Booking Services. The User therefore undertakes to read the terms and conditions concerned before booking and using each particular service.

LAW AND APPLICABLE JURISDICTION

These General Conditions shall be governed by Spanish law, which shall apply where not otherwise provided herein, in relation to interpretation, validity and execution. The parties hereto expressly submit to the Courts and Tribunals of the place of compliance with the obligation in order to resolve any dispute that might arise in relation to the implementation and/or execution of these General Conditions.

EXEMPTION FROM LIABILITY

The User acknowledges and accepts that Avis does not accept liability for any loss or damage that may arise from, for example, but not limited to the following:
  • Delays or blocking of the Internet or any other electronic system caused by deficiencies or overloads;
  • The impossibility of providing the service or permitting access due to any cause for which it is not responsible;
  • Interference, omissions, interruptions, computer viruses, faults and/or disconnections in the operation of this electronic system or in Users' computer equipment and apparatus;
  • Any incorrect operation of the service for reasons outside its control and that may prevent the booking being made effective. Incorrect operation is understood to mean bookings that are incorrectly issued or contain errors of any kind.

PERSONAL DATA PROTECTION POLICY

Any information of a personal nature that the User discloses to us during the process of booking vehicles will be treated in accordance with our Privacy Policy, available on the Avis Web site and which can be accessed via the following link: Privacy Policy. The User should read and accept this Policy before supplying his personal details to Avis

CHARACTERISTICS OF THE AVIS VEHICLE BOOKING SERVICE

In order to use the vehicle booking service, Users, who must be over 23 years of age, must follow the instructions that appear on screen and accept the booking by clicking the CONTINUE button, which implies giving consent to these General Conditions

The User will be required to execute, amongst others, the following instructions:
  • Select booking details (place and dates of collection and return, group of car, accessories);
  • Quote screen which includes the price applicable to the vehicle booking service;
  • Complete at least the obligatory fields on the personal data form;
  • Read and accept these General Conditions;
  • Click the CONTINUE button;
  • Confirm the booking screen

After performing the actions detailed in the above paragraphs, the User will receive an email in his email account with the details of the booking made.

This system of online booking (whether or not the booking is confirmed) does not constitute a contract for the rental of vehicles. At the time of the rental, when the User collects his vehicle, an agreement will be entered into that will be governed by the laws of the country in which the vehicle is hired.

Avis guarantees a category of vehicle, never a particular model, except in its special Avis Prestige fleet

1. PRICE

CIn general, Users will be able to access the booking service free of charge.

2. SEEING/CHANGING/CANCELLING BOOKINGS

The User will be able to see, change and/or cancel the bookings he has made at any time by clicking the "See/Change/Cancel" button in the "Charges and Bookings" section at the bottom of the homepage of the company's Web site, by introducing his surnames and the booking number assigned. In this way, the User can identify and correct errors in the data entered, or cancel the service without any penalty. However, cancelling or changing bookings made using the "Pay Now" process will be subject to the restrictions laid down in the Terms and Conditions of the "Pay Now" Booking Service and the Terms and Conditions of Prestige Booking.

If the User wishes to raise any queries or problem that has arisen in relation to booking vehicles or make a complaint to Avis, he can send a letter to the Avis address shown in the first section of these General Conditions or send an email to the following address: atencion.alcliente@avis.es.

Vehicles belonging to the categories: Medium People carrier, Large Executive, Large Estate and Large Prestige are requested pending confirmation of the booking. The customer will receive an email within 72 hours confirming the booking or informing him that the vehicle requested is unavailable.

CONDITIONS OF RENTAL

When the User is ready to pick up the car and pay for the booking, he will be asked to sign a rental agreement with Avis. The agreement will govern the User's rights and liabilities in relation to the vehicle hired

Avis reserves the right to refuse to rent its vehicles to individuals who are:
  • Below the minimum age applicable to the service for which the booking is made;
  • Do not hold a valid and officially recognised driving licence;
  • Constitute an unjustified risk; or that are
  • Unable to meet the standard requirements necessary for credit or payment in cash applied by Avis at any given time, in accordance with current rates.

If the User uses an AWD when making a booking, he must provide proof of entitlement when he collects the vehicle.

RATES AND CHARGES

The booking service for vehicles will be valid for the groups of car specified in the country of the rental, always subject to availability.

The rates for this service may vary depending on the season and the offices and are subject to change

The amount of the rental of the vehicle can be charged to an Avis account or any of the leading credit cards accepted by Avis. Otherwise, it will be necessary to make a cash deposit for the approximate cost of the service plus 20%.

Cash rentals are permitted for 3-door Small-manual-economy categories of car to the Large-manual-superior categories and are subject to final approval by the rental office. If the information provided by the User is insufficient or cannot be easily checked, rental will be refused

In the case of the Large-automatic-executive and Large-automatic-luxury categories of car, it will be necessary to show two credit cards accepted by Avis.

The User undertakes to pay any parking or traffic fines he may have incurred.

There is a one-way charge for picking up and dropping off the vehicle at different offices. This varies depending on whether rentals are between neighbouring or non-neighbouring areas as shown in the following table::
Exceptions: Rentals between Madrid airport and Barcelona Airport are exempt from the one-way charge (i.e. Madrid Airport-Barcelona Airport or Barcelona Airport-Madrid Airport).

Likewise, the charge for an airport, railway station or sea port pick up, if applicable, must be paid.

For vehicles hired at Spanish airport offices there is an additional charge of 38.00 Euros (not including VAT).

For vehicles hired at offices located at Spanish railway stations there is an additional charge of 14.50 Euros (not including VAT).

For vehicles hired at offices in Spanish High Speed Train (AVE) stations there is an additional charge of 19.50 Euros (not including VAT).

For vehicles hired at offices in sea ports there is an additional charge of 8.00 Euros (Not including VAT).

LRental days will be calculated at periods of 24 hours as from the exact time when the User has rented the vehicle and until the vehicle, its keys and documentation are received by the renter. The courtesy period when returning the vehicle shall be 29 minutes.

Charges for items that have been lost: triangles 22.06 Euros, reflective jacket 6.86 Euros and vehicle keys from 61.80 Euros depending on the group of car.

ADDITIONAL CHARGES

The amount that appears in the AMOUNT box shows the payment made by the User for the car rental services up to said amount. The User shall be liable for paying Avis all the charges that he may incur over and above said sum. If the User incurs any additional charge or expense Avis, without prejudice to applying the surcharge or expense, reserves the right to charge a sum for the duly justified administrative expense incurred for making that change.

1. TAXES

All charges are subject to the applicable tax. In Spain these taxes are:
  • Mainland Spain and the Balearic Islands: VAT at 16%.
  • Canary Islands: IGIC at 13%.

2. ADDITIONAL DRIVER

In Mainland Spain and the Balearic Islands, the charge for an additional driver is 8 Euros (not including VAT) per day up to a maximum of 80 Euros (not including VAT). In the Canary Islands the charge for an additional driver is 5 Euros (not including IGIG).

3. DRIVERS UNDER THE AGE OF 25

In Spain, there is a charge of 15 Euros (not including VAT) per rental day and driver for drivers under 25, up to a maximum of 150 Euros (not including VAT).

The local Avis supplier reserves the right to apply the surcharges when the vehicle is picked up if the User is under 25.

4. FUEL

Avis rates do not include the cost of fuel. Avis normally supplies the vehicle with a full tank of fuel. If for any reason, it cannot be returned with a full tank, Avis will charge the difference for the fuel used plus an additional charge of 16.00 Euros in Mainland Spain and 8.76 in the Islands (Balearic and Canary Islands) for expenses. For greater convenience, we also offer the possibility of pre-paying a tank

5. ACCESSORIES

In Spain we have child seats at a charge of 8 Euros (not including VAT) per rental day and per seat, up to a maximum of 60 Euros (not including VAT).

We also have ski racks and chains that should be requested when booking. The charge for these accessories is 54.13 Euros (not including VAT) for the duration of the rental..

If you want, you can also have a GPS in Mainland Spain and the Balearic Islands at a charge of 12 Euros per day (from 1 to 7 days), 84 Euros per week (from 8 to 19 days + 10 Euros for each additional day) or for a maximum charge of 224 Euros (for rentals of 20 to 31 days). In the Canary Islands the charge for a GPS is 5 Euros per day.

Some vehicles do not have the technical characteristics necessary for fitting a roof rack.

6. PICK UPS AND RETURNS IN PLACES OTHER THAN THOSE STATED IN THE BOOKING
  • City offices. Within office hours and city limits


  • Pick up: 24.97 EUR (not including VAT)

    Return: 15.81 EUR (not including VAT)

    On prior request: Outside office hours and within city limits: 46.62 Euros (not including VAT).
  • Outside city limits or in cities without Avis offices.


  • C3-door small-manual-economy, Medium-manual-MPV and Large-manual-estate categories: 0.93 Euros per km (not including VAT). Minimum charge 55.78 Euros (not including VAT).

    Large-manual-superior, Large-automatic-superior and Large-manual-people carrier categories: 1.17 Euros per Km. (not including VAT). Minimum charge 59.94 Euros (not including VAT).
  • Airport offices: outside office hours and on prior request 46.62 EUR (not including VAT)


  • On regular flights due to arrive within office hours but which arrive outside said hours due to delays, the services will be provided at no additional charge.

    Vehicles may not be taken from one island to another or from the Spanish mainland to the Islands or vice versa.

    Large-automatic-luxury, Large-manual-minibus and Large-automatic-people carrier categories: are only available between Madrid, Barcelona, Malaga and Seville. Pick ups or returns in other cities can be made on prior request at a charge of 332.93 Euros (not including VAT).

    Large-automatic-executive, Large-automatic-luxury and Large-automatic-people carrier categories: there is a charge of 41.63 Euros (not including VAT) for returning the vehicle at an office other than that specified in the contract at the time of picking up the vehicle.
  • Additional charge for vehicles


  • There is an additional charge for rentals of vehicles in the Large-minibus, People carrier-automatic and Large-luxury categories outside the provinces of Barcelona, Madrid, Malaga and Seville. For more information contact our information centre on 902 180 854.

Customers who have collected their vehicle and wish to extend the rental days, should contact the office where they picked it up directly.

7. AVIS ADMINISTRATION CHARGE

An administration charge of 30 Euros per penalty is applied for dealing with traffic penalties (fines).

AVIS also makes an additional charge of 35 Euros for handling an accident and/or vehicle theft report.

DRIVING LICENCE

The User must have held a driving licence for at least one year and be over 23 years of age, or over 25 in the case of certain vehicles.

AVIS ASSISTANCE

In Spain, Avis offers a free travel assistance service 24 hours a day with Europ Assistance. Telephone: 91-597-21-25.

During office hours the User should contact the office where he rented the vehicle.

INTER-EUROPEAN PROGRAMME (One Way)

The attractive Inter-European programme allows the User to return cars in the 5-door Small-manual-economy to the Large-manual-Superior categories under certain conditions, in many European cities.

MOBILITY OF VEHICLES

Vehicles may not be taken between different Islands or between the Spanish mainland and the Islands or vice-versa, or to the autonomous cities of Ceuta and Melilla. Neither is the User authorised to transport the vehicle on board any kind of ship, train, lorry or aircraft (except with express authorisation in writing by Avis).

The vehicle is only authorised to be driven in the continental countries that form part of the European Union: Germany, Austria, Belgium, Cyprus, Denmark, Slovenia, Spain, Finland, France, the Netherlands, Ireland, Italy, Luxembourg, Malta, Portugal, the United Kingdom and Sweden

1. SECURITY OF THE VEHICLE

Avis vehicles carry, at no additional cost, Obligatory [Third Party] Car Insurance with complementary Civil Liability and bail with unlimited guarantees.

The vehicle insurance does not include cover for the following items: damage to the vehicle as a result of collision, theft, vandalism, theft of personal effects, death or injury to the User or passengers travelling in the Avis vehicle.

PIn order to protect Users against additional liability to that of the vehicle insurance (cover for the User, passengers and personal effects carried in the vehicle), Avis offers a complete package of protection that includes the following optional cover:

2. PARTIAL PROTECTION AGAINST DAMAGE TO THE INTEGRITY OF THE VEHICLE (CDW)

Partial protection for damage is not exactly an insurance, it is optional protection that partially releases the User from financial liability for damage to the Avis vehicle as a result of a collision or acts of vandalism.

If the User does not accept partial protection for damage, he will be liable not only for paying the cost of repairing the vehicle, but also for any other expenses and costs that may derive from said damage such as transport and/or towing costs, non-use of the vehicle and/or loss of earnings up to a maximum amount of the vehicle's market value.

If the User accepts partial protection for damages, he will only be liable for payment of a non-waivable excess, in the event of damage to the vehicle, as shown in the relevant table. The non-waivable excess for damage will be applied in all the vehicles of the fleet owned by Avis Espaņa or Licensees of Avis Espaņa, irrespective of the rate applied in the contract, unless stipulated to the contrary.

This amount will be returned to the User within two months if third party liability is proven, and if there is a mutual accident declaration in which a third party admits liability. .

3. PARTIAL PROTECTION AGAINS THEFT OR DIMINISHMENT OF THE VEHICLE (TP)

This optional cover partially relieves the User of financial liability for the total or partial loss of the vehicle as a result of theft.

If the User does not accept partial cover for theft, in the event of total or partial theft of the vehicle, he will be liable for the cost of its replacement, up to a maximum financial liability equivalent to the value of the Avis vehicle.

If the User accepts partial cover for theft, he will only be liable for paying a non-waivable excess for partial or total theft of the vehicle, as shown in the applicable table.

Diminishment shall be understood as the absence when the vehicle is returned of any of its elements or components, documents, parts, tools or original accessories and any other additional accessories the User may have requested. The non-waivable excess shall be applied to any vehicle of the fleet, owned by Avis Espaņa or Licensees of Avis Espaņa, irrespective of the charge made in the contract, unless stipulated to the contrary.

4. FULLY COMPREHENSIVE PROTECTION AGAINST DAMAGE, THEFT OR DIMINISHMENT OF THE VEHICLE (CDW + TP)

Avis offers its Users the possibility of fully comprehensive cover against damage, theft or diminishment of the vehicle due to collision or theft.

By accepting fully comprehensive cover for damage and theft, the User is relieved of financial liability for damage to the integrity of the vehicle or for its theft or diminishment.

The price of this cover varies depending on the group of car and the length of the rental, as shown in the applicable table.

5. INSURANCE FOR OCCUPANTS (PAI/SUPER PAI)
When you rent an Avis vehicle, it has the security and reliability that our Company provides. However for complete peace of mind, we can provide insurance that covers injury or death of the occupants. This insurance also covers theft of personal effects, solely from the vehicle's boot.

There are two levels of cover available in Spain, called PAI and Super PAI.

If the User accepts Avis Assistance (PAI) or Avis Double Assistance (Super PAI), he will be covered by the Avis Assistance guarantees that include personal injury, up to the maximum established, under the conditions set out in the original policy (AIG Policy nš 0021280045000) which is held at the Avis Central Office. In addition, buying Avis Double Assistance gives the User the benefits of an insurance policy for the theft of personal effects up to the maximum established in the original policy, provided they are in the vehicle's boot, and this has been forced. Any theft must be reported to the police and a copy of the report obtained.

Claims should initially be made at the nearest Avis office or on the Avis emergency telephone number that appears in the rental agreement folder.r.

6. CHECKING THE STATE OF THE VEHICLE

Avis procedures establish that the vehicle will be checked at the time of rental and when it is returned, in order to identify any damage and determine liability

When the User picks up his vehicle, the Avis Agent should check the vehicle and note on the rental agreement any damage he has noticed.

When the User returns the vehicle, it should be checked again and any damage compared with the list for the vehicle when it left. If damage appears on the return list that was not on the list when it was picked up, this damage will be assumed by the User.

In the case of damage to the vehicle or an accident, the User is obliged to complete an accident report whether or not he was the person responsible, with or without a third party being identified and must send it, within 14 days, to the Insurance Department of our central office in Madrid.
