1. Booking Terms and Conditions

1.1. This Agreement is not an agreement for the provision VEHICLE RENTAL SERVICES. The Rental Services (the "Rental Services") will be provided in accordance with a rental agreement entered into separately with a member of the Avis Rent A Car System that provides the vehicle (the "Local Supplier"), entering into this agreement being obligatory unless you are already an Avis Preferred customer when you pick up your vehicle. You will also be subject to the Avis general conditions relating to driving qualifications.

1.2. In the case of "Pay Now" bookings, you are entering into this Agreement with Avis Finance Company plc ("AFC") (see the Terms and Conditions of the "Pay Now" service given below).

1.3. In the case of "Pay Later" bookings, you are entering into this Agreement with the Local Supplier.

2. Terms and Conditions of the "Pay Now" service

2.1.By clicking the "accept" button in the booking process, you will only be entering into this Agreement with AFC and are bound by its Terms and Conditions. By entering into this Agreement, you are agreeing to purchase a face value voucher (the "Voucher") from AFC for the amount of the AFC quote. AFC will issue the voucher, and send it to you by email and will book the Rental Services. You may exchange the voucher for the Rental Services with the Local Supplier where you pick up your vehicle on presentation of the voucher.

2.2. You must pay the quoted charges relating to the voucher that, on redemption, entitles you to the rental services in full at the time you make your booking on the web site. The charges will be deducted from your credit or debit card at the time of booking. The voucher will not be issued until payment has been made in full. By entering into this Agreement you expressly authorise AFC to debit your credit or debit card the amount shown on your voucher and the additional charges (if any) laid down in this Agreement.

2.3. The voucher you have purchased may be exchanged for the rental, inclusive of VAT, of the selected vehicle for the dates you have booked, together with the items specified as included in the price when you make your booking at the rates quoted to you by us. You can view these items by following the "Your charge includes" link from the "Charges" page.

2.4. All other optional equipment and services (e.g., special equipment, additional drivers, optional insurances, fuel, additional days) will incur additional charges, whish you must pay directly to the Local Supplier when you pick up or return your vehicle. Additional charges may also be made by the Local Supplier when you pick up your vehicle if you are under the age of 25.

2.5. If you cancel your booking a cancellation fee of €25 (€50 in the case of vehicles from the Avis Prestige Fleet) will apply by way of compensation to AFC, which will reimburse any part of the face value of the voucher that exceeds the cancellation fee.

2.6. . If you fail to pick up your vehicle within 24 hours from the reservation date and time shown in your booking a non-appearance fee of €95 (€150 in the case of vehicles from the Avis Prestige Fleet) will be charged by way of compensation to AFC, which will reimburse any part of the face value of the voucher that exceeds the cancellation fee.

2.7. In order to obtain a refund of the amount paid shown in your booking voucher, you must write to the following address requesting a refund. The letter requesting reimbursement must always be signed, and can be sent by post, fax, or scanned and sent as a file attached to an email. 2.8. To avoid doubt, AFC will make no refund if:

a) You do not use any part of your booking period; or b) You change your booking and the charges for the Rental Services are less than the amount you paid for the original booking.

3.Changing Bookings

3.1. Subject to availability and the restrictions in clause 3.2 below, you can change your booking up to 24 hours prior to picking up our vehicle via this web site or up to the time of the rental by calling the Avis Call Centre on +34 902 180 854. Subject to the conditions set out below, you can use your voucher as payment for these alternative services.

3.2.Changes to bookings are subject to the following restrictions:

a) If you change a booking and the charges for the Rental Services are greater than the face value of your voucher, you will be charged the difference at the Avis rates current at the time, and the additional amount will be payable at the time of modification. b) If the cost of the booking invoice is less than the cost of the face value of the voucher, NO REFUND WILL BE MADE.

4. General Provisions

4.1. Nothing in these Terms and Conditions restricts your statutory rights relating to refunds.

4.2. AFC or the Local Supplier, as applicable, will be responsible for any losses you may suffer as a result of AFC or the Local Supplier breaching this Agreement where said losses are a foreseeable consequence of the breach in the light of the circumstances of the case. Losses will be foreseeable where they are in AFC, the Local Supplier or Your contemplation at the time the booking is made. AFC or the Local Supplier shall not be responsible for indirect losses arising out of the main loss or damage and which are not foreseeable by AFC, the Local Supplier and you (such as loss of profits or loss of opportunity).
